CLIENT CHARGED WITH THEFT AND ORGANIZED FRAUD FOR STEALING OVER $80,000 OF CONSTRUCTION MATERIAL WILL HAVE HIS CASE DISMISSED

Erick Cruz negotiated acceptance into the pretrial intervention program for a client charged with grand theft and organized fraud for stealing over $80,000 of construction material.  The client who initially was facing up to 15 years in prison, will have his case dismissed once he completes a theft program and remains out of trouble for six months.

The client worked as a dump truck driver receiving and delivering construction material.  In an alleged conspiracy with others, the client would haul the material while paying a significantly reduced price.  The client would later resell the material and keep the profit.  The police conducted a detailed investigation including surveillance and forensic audits to discover and prove the crime.

When the client hired Erick, he immediately got to work by negotiating down the restitution amount.   Erick convinced the prosecutor and the victim to accept $15,000 instead of the original $80,000.  When the proposal was accepted, the client made an initial lump sum payment and monthly payments thereafter.  When he completes the payments, his case will be dismissed and he will be eligible to have his case expunged.
