ERICK CRUZ GETS CLIENT'S POSSESSION OF COCAINE CASE DISMISSED AT FIRST COURT APPEARANCE

By Erick Cruz April 10, 2017 Posted in News, Victories

A client who was at a nightclub was stopped by police who alleged that he was acting suspicious.  The officer stopped and searched him and found cocaine.  The client was arrested and charged with possession of cocaine.  Unfortunately, the client did not have legal status in the United States and was concerned what the consequences of this arrest would have on his immigration status.

The client retained Erick Cruz to represent him.  Erick got to work immediately on the case and spoke to the prosecutor who was assigned to investigate the case.  Erick explained to the prosecutor that there was insufficient evidence to stop and search the client.  Erick researched the applicable laws and provided the laws and cases to the prosecutor who agreed that there was no reason to detain and search the client.  Accordingly, because the stop and search were bad, the prosecutor agreed to dismiss the case at the first court date without the need for the client to go to court at all.
