FEMALE CLIENT CHARGED WITH DOMESTIC VIOLENCE AFTER ALLEGEDLY BATTERING HER HUSBAND HAS HER CASE DISMISSED

A client celebrating her birthday was arrested after she was accused of striking her husband.  The client was charged with domestic violence battery.  Initially, the prosecutors were offering the first offender program that would have resulted in the dismissal of the charges against her.  The client, however, maintained her innocence and pressed forward to trial.

Prior to trial, Erick Cruz got on the case and spoke to the prosecutor and urged him to dismiss the case because there was insufficient evidence since the husband did not want to proceed with the prosecution.  The prosecutor decided to go forward based on independent evidence that he had such as the 911 call and photographs.  Just prior to trial, the prosecutor realized that there was insufficient evidence to proceed and dismissed the case.
