YOUNG CLIENT WHO WAS CHARGED WITH BATTERY ON A POLICE OFFICER AND RESISTING ARREST WILL HAVE CASE DISMISSED AFTER COMPLETING DIVERSION PROGRAM

Erick convinced prosecutors and police officers to allow the client to enter into the pretrial diversion program and ultimately have his case dismissed.  The client was out for the night and had too much to drink.  He got into a shoving match inside a club and was ejected from the club.  When he was outside, he got into an argument with police which led to him shoving the officer.  When the officer tried to arrest him, he resisted arrest.  After the officers arrested him, they found controlled substances and marijuana.

The case was initially filed as a felony, but when Erick was retained, he spoke to the prosecutor and urged them to reduce the charges to a misdemeanor.  Erick explained to the prosecutor that the client was a young kid who made a mistake.  He was going to school and obtained a realtor's license.  The prosecutors agreed and they dismissed the felony charges against him.  

The case was reduced to misdemeanor court, but the police officers were upset that the charges were reduced.  Initially, the officers were asking that the client go to jail, but Erick spoke to them and convinced them to approve the first offender program based on the client's youth and sincere apology.  After completing the program, the case will be dismissed and the client will be eligible to have the case expunged.
