Investigations

You hear a knock on your door; you look out and see two plain clothed detectives waiting for you.  You open the door and the detectives ask you to let them in so that they can discuss with you an investigation they are conducting.  The detectives appear well meaning and reassure you that everything will be okay so long as you tell them the truth.  In a situation like this, the detectives won’t inform you of your right to remain silent or that you are the target of a criminal investigation.  What you don’t know, however, is that they may very well be setting you up to make an incriminating statement that will later be used against you. 

At this point it is critical that you assert yourself and let the officers know that you want to consult with a criminal defense attorney before speaking to them.  Beware, however, that there is a crucial difference between lying to an officer and remaining silent.  Your silence cannot be used against you; a lie, however, can.
